: Details of the Verdict

The Fifth Criminal Division of the Court of Felonies, presided over by Judge Khaled Al-Omeira, ruled for the acquittal of a prison officer and two inmates from charges of drug possession and dealing, drug smuggling into prison, bribery, and money laundering. The court also acquitted the two inmates of similar charges related to drug possession and bribery

: Case Summary

The case began when the investigating officer received information implicating the first and second defendants, who were inmates at the central prison, in drug trafficking activities. Acting on this information, the officer obtained a warrant from the Public Prosecution and raided the defendants' prison cell. The raid resulted in the seizure of drugs and a mobile phone. Additionally, a transfer of 700 Kuwaiti Dinars linked to the third defendant (the prison officer) was discovered

During interrogations, all defendants denied the accusations. The third defendant claimed he had no connection to the drugs or the money involved

: Defense by Lawyer Bashar Al-Nassar

Representing the third defendant (the prison officer), lawyer Bashar Al-Nassar argued that the arrest warrant issued by the Public Prosecution was invalid as it was based on unreliable investigations. He highlighted that the time gap between the arrest of the first two defendants and the issuance of the warrant for the third defendant was only 15 hours, which is unreasonable

Al-Nassar pointed out that it is highly unlikely that the officer conducting the investigations could have worked continuously for this extended period without rest, suggesting that the investigations were either rushed or conducted under extreme pressure, thereby lacking credibility

:Inconsistencies in the Officer’s Testimony

Al-Nassar also noted contradictions in the officer's statements during the trial. At one point, the officer claimed the 700 Kuwaiti Dinars were a bribe, while at another, he stated it was the proceeds of drug trafficking

The lawyer emphasized that attributing two separate charges (bribery and drug dealing) to the same amount lacks legal coherence and undermines the validity of the accusations

:Court’s Decision

After thoroughly reviewing the defense arguments presented by lawyer Bashar Al-Nassar, the court ruled that the arrest and search procedures were invalid. Consequently, all subsequent charges against the defendants were dismissed, leading to the acquittal of the prison officer and the two inmates from all charges
